painter, photographer, wax modeller and picture-frame maker, arrived at Western Australia on board the Marion on 31 January 1852 as an unmarried convict sentenced to transportation for seven years. He was given a ticket of leave on arrival. On 5 March 1852 he advertised in the Perth Gazette :

A Respectable young man, a ticket of leave holder, wishes for an indoor occupation, where he would make himself generally useful in any capacity. He would devote any spare time to painting likenesses, landscapes, modelling wax fruit and flowers for drawing room ornaments, and manufacturing a new style of picture frames for his employer. He would also give instructions for taking daguerreotype portraits as practised in London. Direct to E.E.M. at this office. Perth Feb. 26. 1852.

Although he did not receive his conditional pardon until 9 September 1854, Miller was employing a ticket-of-leave man at Perth the following year but whether this was in order to carry out some of his enterprises commercially is unknown. Many years later he was still painting; various pictures of ships have been recorded.
